Below you will find an important list of various policies and terms of service.  When placing an order or service with Native Apothecary, you are agreeing to the below terms.  Please read carefully and reach out via the CONNECT page with any questions or concerns.

Payment POLICIES:

We accept payment via credit card, ApplePay or Paypal.

All orders are made in United States currency.

All products are sold on a first come, first served basis only and are final.  Please message via the CONNECT page if you have any questions.

Native Apothecary will only work with wholesale accounts that have a physical store.  Invoicing wholesale accounts occur in PayPal only.  Wholesale accounts are not permitted to sell Native Apothecary products on their website.  

 

Shipping:

Items will be processed within 2-7 business days of the purchase date. This time frame may be longer during the holiday months of October, November, and December. Once your order is processed, it will be given a tracking number and shipped.   When your package is shipped, you will receive an automated e-mail with your tracking number via USPS. Please allow 24 hours for tracking information to appear online.  Remember to check your spam in-box, if you aren't able to locate this information.  It may have landed in there.   

The customer is responsible for providing the correct mailing address and e-mail address upon checkout. If you entered the wrong shipping address please CONNECT with us as soon as possible with the correct one. If your item has not yet shipped, your address can be changed. If your package is already in transit (meaning, it has a tracking number), it cannot be changed.

Holiday Shipping Deadlines:

Shipments outside of the U.S.- December 10th, 2018

Shipments within the U.S.- December 14th 2018

These are the order deadline dates that will ensure your package arrives before the December holidays. For further shipping information, please read the general shipping terms located below.

U.S. customers: 

All orders will be fulfilled within 7 business days of order date.

You can expect your items to arrive within 2-8 days after they are shipped. "Retail Ground" is shipped via USPS Retail Ground Mail and comes with a tracking number, but no insurance. "Priority Shipping" is shipped via USPS Priority Mail and comes with tracking number and insurance. All shipping costs are calculated by the United States Postal Service.

Native Apothecary is not responsible for lost packages if your tracking number indicates your order was "delivered." 

International customers: 

Due to the nature of the wildcrafted remedies Native Apothecary creates, international shipping is not available.  This is due to customs regulations of the receiving countries. 

All orders will be fulfilled within 7 business days of order date.

When purchasing The Hedge Witch's Herbal Grimoire, please select "International Shipping".  The cost to ship one book to all locations outside of the US is $23.50USD. Please note that there will be no tracking information provided for your shipment.  Your purchase will be shipped via USPS First Class Package International Service.   All shipping costs are calculated by the United States Postal Service.  According to the USPS, you can expect your items to arrive within 6-10 business days after they are shipped.  

All packages will be marked as 'merchandise' on the Customs Declaration Form, no exceptions.  It is your responsibility to be aware of your country's import taxes and duty fees.  Native Apothecary is not responsible for these extra costs that are set by your country's customs office. 

Canadian customers: 

When purchasing The Hedge Witch's Herbal Grimoire, please select "Canadian Shipping".  The cost to ship one book to all locations in Canada is $16.00USD.  Please note that there will be no tracking information provided for your shipment.  Your purchase will be shipped via USPS First Class Package International Service. All shipping costs are calculated by the United States Postal Service.  According to the USPS, you can expect your items to arrive within 6-10 business days after they are shipped.

CANCELLATION POLICY:

Workshop and Native Alchemy Path tickets are non-refundable.  You may transfer your ticket to another person, but please let us know via the CONNECT page.

If you need to reschedule a Wellness Session, please visit the CONNECT page within 24 hours of the appointment.  A $25 USD fee will be charged if notice of reschedule is not received.

 

MEDICAL CONCERNS:

By US law, Herbalists are unable to diagnose or treat any health issues.  

Herbalists are trained in the interaction between plants and humans.  We are familiar with human anatomy and pathology, but are not experts according to US law.  

As an herbalist, Alison Garber will work with her Wellness Session clients to restore balance, health, and harmony through the use of herbal preparations, lifestyle adjustments, and nutrition advice.  

All herbal remedies created by Native Apothecary have not been evaluated by the US Food and Drug Administration.  Our products are not intended to diagnose, treat, cure or prevent any diseases.  Please consult your qualified physician before consuming.

 

Privacy Policy:

Your privacy is important to us and we want to make sure that you (“you(r)” or “user(s)”) understand our policies and practices. We also provide opportunities for you to choose what information you give us, delete previously provided information, and options to opt out of . This policy shall apply to www.nativeapothecary.net (“Site”), transactions through the Site, our newsletter and email communications, our classes booked through the Site, and any related applications (“apps”), and/or any other service provided by Native Apothecary, LLC (“Native Apothecary” or “We”). The Site, and all activities described in the preceding sentence shall be referred to as the “Services.”

1. Acceptance of this Policy

Please read this policy in full and know that by using our Services you are also confirming that you have read and understand this policy including how and why we use your information. If you do not wish to have us collect or process or process your personal information then you should not submit any information or make any purchases through the Services. If you wish to have any information removed from our servers, contact Native Apothecary through the contact information at the bottom of this statement. You understand that we use additional third party services, including Squarespace and Mailchimp, and others that may not be directly described in this Policy, and sometimes we direct users to other websites and services. We are not responsible for the privacy policies, content, terms, etc. of these third parties. You must be at least 18 years of age to use this website. We do not knowingly collect any information or advertise to Minors under 13 years of age. Minors between the ages of 13-18 must only uses the Services with parental control and consent. Children under age 13 are not permitted to use the Services. If you are the parent or guardian of a child whom you believe has disclosed Personal Information to us, please contact us through the contact information at the bottom of this statement so that you may review the information submitted and have such child’s information deleted and removed from our systems.

By using the Services, you understand that Native Apothecary is operated in the United States. Native Apothecary sees and can delete the information provided by you, but does not have its own servers and does not host information. The Site is hosted by SquareSpace and Native Apothecary’s newsletter is transmitted through MailChimp (The Rocket Science Group, LLC). These sites state that they are GDPR compliant. Information is held on servers provided by SquareSpace, which maintains servers around the world, and Mailchimp which maintains servers in the United States.

How your data is treated and transferred is detailed below.

2. Information Collected or Received

To use the Services you may need to enter, and we shall collect, a certain amount of personal information, which is detailed below. If you do not wish to transmit personal information, do not purchase anything off of the site or sign up for our newsletter. There are also opportunities to opt out of the collection of certain information, which you may take advantage of.

Payments: Payments for items and workshops (any of the Services requiring payment or registration) requires the submission of personal information. You will need to submit all or any of the following: full name, email address, mailing address, billing address, credit/debit card information, and any additional information required by PayPal, Inc., Stripe, Inc., or Squarespace, Inc. Native Apothecary will receive your name, email address, and mailing address, or any other personal information submitted as may be required to carry out the Services. Credit card and other payment information is seen, processed, and held by the third-party payment processors, Native Apothecary does not see or hold your credit card or payment information.

General User Info: We receive or obtain information (for example, an email address or IP address) from a user shopping or visiting the Services (“General Users”). The information collected from General Users is used only for the purposes disclosed to them when it was submitted to Native Apothecary or to carry out the Services. This information may be collected via cookies, which is explained in the next paragraph.

Cookies: We may use cookies on our site. Most browsers accept cookies by default. You can choose to set your browser to do otherwise. Note, however, that if you remove cookies, it may affect the functionality of, and therefore your interaction with, our Services.  Squarespace and MailChimp also may use cookies we use since we use them to carry out the Services. You can read more about their practices in their privacy policies which are listed above under Section 1.

3. Control of Information

You are able to choose what information you provide, and remove and/or permanently delete information whenever you like by contacting us at the address stated at the bottom of this Policy.

If you wish to have a copy of the data collected by Native Apothecary you may contact us via the contact information stated at the bottom of this Policy.

We may send you communications via any of the contact information you provide us. Communications related to the functionality of the Services, transactions, or legal notices are required and you cannot opt out of them. You may opt out of non-required communications such as notifications, marketing, newsletters, emails, etc. via the the unsubscribe option in the communications, or through contacting us through the contact information at the bottom of this statement.

4. Use of Information and Disclosure

As described above, we collect your information to carry out the Services. We use and share this information only for the following purposes:

  • To fulfill our obligations and provide the Services to you;

  • To perform any contractual requirements in carrying out the Services;

  • In any ways you have directly consented to through our Site and/or Services;

  • To comply with a legal obligation, court order, subpeona, or in the defense of legal claims;

  • To third parties to the extent necessary to fulfill the Services or marketing on our behalf;

  • In order to contact you as described in this Agreement; and

  • As may be necessary in the public interest.

This policy only applies to information directly collected by Native Apothecary. Information provided to PayPal, Inc., Stripe, Inc. and other third parties through the Services is subject to their respective privacy policies. Furthermore, Native Apothecary is not responsible for any information you transmit to third parties. Native Apothecary is not responsible for the privacy or security practices of any of the third parties, or other websites on the Internet, even those linked to or from the Site. You should read the privacy policies and terms of use of all parties you transmit information to. For the purposes of European law, third parties and other users are independent controllers of data, and therefore they are solely responsible for complying with all applicable laws, regulations, and their own policies relating to personal information.  

5. Transfers

As may be necessary, and to the extent required for the provision of the Services, personal information may be transferred to third parties outside of EU/EEA. This data is managed by Squarespace and Mailchimp. Native Apothecary does not directly transfer your data anywhere, and Squarespace and Mailchimp’s transfer policies are described below, and in further detail in their privacy policies.

Squarespace states on its Privacy Policy that:

“[Squarespace] may, in accordance with Article 46 of the GDPR, transfer personal information to recipients that have entered into the European Commission approved contract for the transfer of personal data outside the European Economic Area.”

The Rocket Science Group LLC states:

“MailChimp participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. We are committed to subjecting all Personal Information received from European Union (EU) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to each Framework’s applicable Principles. To learn more about the Privacy Shield Frameworks, and to view our certification, visit the U.S. Department of Commerce’s Privacy Shield website, here.

A list of Privacy Shield participants is maintained by the Department of Commerce and is available here.

MailChimp is responsible for the processing of Personal Information we receive under each Privacy Shield Framework and subsequently transfer to a third party acting as an agent on our behalf. We comply with the Privacy Shield Principles for all onward transfers of Personal Information from the EU and Switzerland, including the onward transfer liability provisions.”

6. Security

We take steps to keep your information safe including commercially reasonable protection measures put in place by Squarespace and Mailchimp, and any other third-party services we may utilize.

7. Retention

Native Apothecary keeps your information to carry out the Services. Again, you may request that we delete it at any time. We will only retain information after you have indicated you no longer wish us to use the information to the extent necessary to comply with legal obligations.

8. Updating this Policy

We may update this policy from time to time. We suggest you regularly check this Policy for any such updates. We will also advise you when we make changes via the contact information you have provided us. Your continued use of the Services after such notification constitutes your consent to the updated Policy.
